These Terms and Conditions constitute a legally binding agreement between you and 3c NET PVT Ltd. ("Company", "we", "us", or "our"), operating as TowMyCar.uk. By accessing or using our Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Definitions and Interpretation

In these Terms, unless the context requires otherwise:

  • "Company" means 3c NET PVT Ltd., registered in the United Kingdom (Company Registration No. 16204011).
  • "Platform" means the TowMyCar.uk website, mobile applications, APIs, and related services.
  • "Services" means vehicle transportation, towing, recovery, and roadside assistance services.
  • "Service Provider" means independent contractors providing vehicle transportation services.
  • "User" means any person accessing or using the Platform.
  • "Customer" means individuals or entities requesting transportation services.
  • "Booking" means a request for Services made through the Platform.

2. Platform Services and Limitations

2.1 Platform Role

  • We operate as a technology platform connecting Customers with Service Providers.
  • We do not provide transportation services directly.
  • We are not responsible for the actual performance of transportation services.

2.2 Service Provider Relationship

  • Service Providers are independent contractors, not employees.
  • We verify basic credentials, including insurance and licenses, but do not guarantee service quality.
  • Service Providers must maintain comprehensive commercial insurance in line with UK regulations.

2.3 Misuse of Platform

  • If a Customer selects the wrong category or provides false information, it will be handled according to the Service Provider's individual policies.
  • Until a booking is confirmed, Customers and Service Providers are strictly prohibited from exchanging any contact details. Violation of this rule may result in account suspension.

3. User Registration and Account Security

3.1 Account Requirements

  • Must be at least 18 years old.
  • Provide accurate, current, and complete information.
  • Maintain and update account information.
  • Keep login credentials secure and confidential.

3.2 Service Provider Documentation

  • Service Providers must upload valid insurance documents, public liability certificates, and licenses during the registration process.
  • If any of these documents are updated or changed after registration, the Service Provider must inform TowMyCar.uk and update the documentation within 24 hours.
  • For your safety and compliance with regulations, TowMyCar.uk may temporarily restrict account access, including the ability to accept new bookings or interact with the platform, if required documentation expires. Full access will be restored once valid, up-to-date documents are provided.

4. Booking and Payment Terms

4.1 Booking Process

  • All bookings are subject to Service Provider availability.
  • Prices are set by individual Service Providers.
  • Additional charges may apply for extra services or waiting time.

4.2 Payment Terms

  • Secure payment processing through Stripe.
  • TowMyCar.uk immediately collects the job commission from the Service Provider once the job is confirmed.
  • We do not handle payments for the actual service provided; transactions occur directly between the Customer and the Service Provider.

4.3 Cancellation Policy

  • Cancellations made at least 12 hours before the scheduled service are free.
  • Cancellations made within 12 hours of the scheduled service may incur fees as determined by the Service Provider's individual policies.

5. Insurance and Liability

5.1 Insurance Requirements

  • Service Providers must maintain comprehensive commercial insurance as per UK regulations.
  • Proof of insurance must be provided and kept current.

5.2 Limitation of Liability

  • Our maximum liability is limited to the commission amount paid by the Service Provider for the service.
  • We are not liable for any damages, losses, or issues related to the actual transportation service.
  • We are not responsible for delays or service failures due to force majeure events.

6. Data Protection and Privacy

6.1 Data Processing

  • We comply with UK GDPR and the Data Protection Act 2018.
  • Personal data is processed as outlined in our Privacy Policy.
  • Security measures are in place to protect user data.

7. Intellectual Property

7.1 Platform Content

  • Software, designs, text, graphics, and interfaces.
  • Trademarks, logos, and brand features.
  • Are owned by or licensed to the Company.

7.2 User-Generated Content

  • Users may post reviews, comments, and other content.
  • By submitting content, users grant TowMyCar.uk a non-exclusive, royalty-free license to use, display, and distribute such content.

8. Membership and Fees

8.1 Service Provider Membership

  • The first 250 registered Service Providers receive free membership.
  • Subsequent Service Providers must pay a membership fee.
  • Fixed commission charges apply for each confirmed booking.

9. Dispute Resolution

9.1 Resolution Process

  • Initial resolution through customer service.
  • Mediation before legal proceedings.
  • Jurisdiction under English courts.

9.2 Governing Law

  • These Terms are governed by and construed in accordance with the laws of England and Wales.
  • Disputes shall be resolved in the courts of England and Wales.

10. Termination

10.1 We reserve the right to

  • Suspend or terminate accounts for violations of these Terms.
  • Modify or discontinue services at any time.
  • Block access for suspicious or fraudulent activity.
